Bluelink Subscription - Term & Condition

1. Scope

  • These terms are in addition to “Hyundai Bluelink Terms of Use” accepted by You initially at the time of free subscription of Bluelink and applicable on paid Subscribers only.
     
    These terms apply to the use of Hyundai Bluelink ("Services") provided by PT Hyundai Motors Indonesia, incorporated and registered in Indonesia whose registered office is at Wisma Mulia Suite 2501 Jl. Jend.Gatot Subroto No.42 Jakarta 12710 ("Hyundai"; "We"; "Us"; "Our") to the user of the Services ("User" or "You").

2. Use of the Subscription

  • 2.1.Subscription fee and payment schedule for continue to receive/use the Bluelink, after the initial free period of 3 years, will be communicated to You through Your application or other communication channel. You may opt to renew the Bluelink services by paying the applicable Subscription Fees.
     
    2.2.After free period of 3 years, Customers shall have valid subscription of Bluelink Application to gain complete access and usage of Services.
     
    2.3.Bluelink subscription for a single vehicle can be accessed on multiple devices.
     
    2.4.If You choose not to renew your Bluelink subscription, Your data will remain saved.
     
    2.5.If You uninstall the Bluelink app, Your Bluelink subscription period will continue as per the plan selected at activation.
     
    2.6.Once Bluelink subscription is purchased by You:
    a) Subscription cannot be cancelled;
    b) Subscription cannot be paused;
    c) Subscription cannot be refunded;
    d) Subscription cannot be transferred to another vehicle with different VIN.
     
    2.7. Bluelink can be transferred to another user with same VIN.
    To transfer ownership of your Bluelink account, you may either self-unenroll via the Bluelink application or contact the Bluelink Support Center to request unenrollment. Registration cancellation will be processed after vehicle ownership verification is completed. Please note that Bluelink services on the vehicle will remain active until the end of the applicable subscription period.
     
    2.8.Bluelink subscription is non-extendable for the period equalling to which You switch devices for whatever reason. Your Bluelink subscription period will continue as per the activation.
     
    2.9.Bluelink subscription is non-extendable for the period equalling to which vehicle undergo for repair or not available for use for whatever reason. Your Bluelink subscription period will continue as per the activation.
     
    2.10.You can renew Your Bluelink subscription before the expired date. Your next subscription period will begin immediately after the current subscription period expires.
     
    2.11.The Bluelink subscription is a standalone service and is not included as part of the warranty provided for the Infotainment System or any other components of the vehicle. Any issues related to the Infotainment System hardware are subject to the separate terms and conditions of the warranty.

3. Subscription Payment

  • 3.1.Bluelink Subscription payments for subscription plans are processed through the Bluelink app or our other app and linked to a third-party payment system, which are Hyundai's payment aggregator partner.
     
    3.2.Payment Authorization:
    a) By subscribing to the service, you authorize us to charge the payment method you provide for the subscription fees.
    b) You confirm that the payment details you provide are accurate, current, and complete.
     
    3.3.Payment Methods
    Payments for subscription plans are accepted through various payment methods, including credit/debit cards, online banking, and other methods as specified during the subscription process.
     
    3.4.Subscription Charges:
    a) The applicable fee will be clearly displayed during the subscription page.
    b) Subscription charges may vary based on the plan selected.
    c) Subscription charges may be subject to applicable taxes, duties, or other governmental charges depending on your location. These charges will be included in your total subscription cost.
    d) All charges will be processed in the currency specified during the subscription process. Currency conversion charges, if any, are the responsibility of the user.
     
    3.5.Payment Failures
    If payment cannot be processed due to insufficient funds, expired payment details, or any other issues, your subscription will be canceled.
     
    3.6.Refunds and Cancellations:
    a) Unless otherwise specified, payments made for subscriptions are non-refundable.
    b) Once Bluelink subscription is purchased by you, it cannot be cancelled.
    c) Once Bluelink subscription is purchased by you, it cannot be paused.
    d) Once Bluelink subscription is purchased by you, it cannot be refunded.
    e) Once Bluelink subscription is purchased by you, it cannot be transferred to another vehicle with different VIN.
     
    3.7.Price Changes
    We reserve the right to change subscription prices at any time. If there is a price changes, Users will be notified in advance before the new rates are applied.
     
    3.8.Failed Payments and Service Interruption
    In the event of a failed payment, access to the subscription service may be temporarily restricted until payment is successfully processed.

4. Promotion

  • 4.1.Promo code Eligibility:
    a) Promo code are only valid for eligible users as specified in the promotional campaign.
    b) Each promo code may have specific conditions, including but not limited to subscription plans, user location, or app version. Details will be outlined in the promotional terms.
     
    4.2.Promo code Usage Restrictions:
    a) Promo code are for one-time use only unless stated otherwise.
    b) Promo code cannot be exchanged for cash, transferred, or combined with other promo code.
     
    4.3.Redemption Process
    To redeem a promo code, Users must enter the code during the subscription process before completing the payment.
     
    4.4.Expiration
    Each promo code has an expiration date, which will be stated in the promotion details. Codes cannot be used after this date under any circumstances.
     
    4.5.Limited Availability
    Promo code may have usage limits (e.g., a limited number of redemptions or a specific campaign duration). Once the limit is reached, the code will no longer be valid.
     
    4.6.Non-Compliance
    Any misuse or unauthorized use of promo code (e.g., reselling or sharing for personal gain) may result in the cancellation of the promotion, termination of the account, or other actions as deemed necessary by the service provider.
     
    4.7.Refunds
    If a User cancels their subscription after redeeming a promo code, it cannot be refunded.
     
    4.8.Changes or Termination
    Hyundai reserves the right to modify or terminate promo code campaigns at any time without prior notice.
     
    4.9.Acceptance of Terms
    By redeeming a promo code, users agree to these Terms & Conditions and any additional terms outlined in the promotion.

5. Auto Renewal Subscription Payment

  • 5.1.By choosing Auto Renewal when you do subscription payment, you agree to enroll in an Auto Renewal program where your subscription will automatically renew at the end of each subscription period, unless canceled.
     
    5.2.Payment Details
    a) By providing payment details and completing your subscription, you authorize Bluelink to charge the subscription fee to your chosen payment method at the start of each renewal period.
    b) Auto Renewal is only available for selected payment methods.
    c) For Auto Renewal to proceed successfully, the payment method must have sufficient funds or balance at the time of renewal. If the required amount cannot be charged due to insufficient funds or other restrictions, the Auto Renewal will fail, and your subscription will not be extended.
    d) You are responsible for ensuring that your payment details remain up to date to avoid service interruptions.
     
    5.3.Subscription Plan
    Your subscription will renew for the same subscription plan as the original subscription term unless otherwise specified.
     
    5.4.Renewal Billing and Grace Period
    For subscription renewals, the system will attempt to charge the registered payment method automatically, starting with a six (6) day and six (6) attempt grace period. If the final renewal payment attempt fails, the subscription will be terminated. However, users can re-subscribe at any time via Bluelink application.
     
    5.5.Billing Date Adjustment
    Subscription renewal charges will occur 30 days from the start date of the current active subscription. If the renewal billing dates falls on irregular dates (29th, 30th, or 31st), then it will automatically adjust to the 28th. However, your next subscription period will begin immediately after the current subscription period expires.

    5.6.Auto Renewal Cancellation
    Auto Renewal charges are non-refundable once billed, except as required by applicable law. If you cancel before the renewal date, your service will continue until the end of the current billing period.
     
    5.7.Changes
    If there are any changes to the subscription plan, pricing, or other details, your Auto Renewal will be automatically stopped. However, your service will remain active until the end of the current billing period.
     
    5.8.Acceptance of Terms
    By enabling Auto Renewal, Users acknowledge and agree to these terms, including any eligibility requirements and the necessity of maintaining sufficient funds or balance for successful payment processing.

6. Network Speed / Availability

  • For the proper function of Bluelink features or availing its services when process the payment, fully functional Application and uninterrupted internet / network connectivity is required. Hence, if Application stops functioning or internet / network connectivity is interrupted due to any reason, Bluelink payment process will stop working immediately.

7. Data Protection

  • 7.2.For information on how we collect and process personal data in connection with the provision of the Services please refer to our Privacy Notice available in the Application
     
    7.2.We recommend the User to inform any other user/driver of the vehicle that the Services are activated. In particular, we recommend to the User to inform such other User about the data processing activities described in the Privacy Notice and the fact that the Services require the collection and processing of financial data that registered to the Application (Bank Account Number).

8. Changes to the Terms of Use and/or to the Services / Assignment of Rights

  • 8.1.Hyundai reserves the right to make reasonable changes to the Terms of Use and/or to the Services to reflect changes in law or best practice or to deal with additional features which we introduce, and to assign our rights and duties under this agreement in full or in part to a third party. The User will be notified by us about any changes to these Terms of Use and/or the Services within a reasonable time ahead of the effective date of the new Terms of Use. In case the User disagrees with the application of the new Terms of Use the Services can no longer be used. In that case, the agreement is terminated with immediate effect.
     
    8.2.In case of any contradiction between the terms of “Hyundai Bluelink Acceptance of Terms of Use” and terms stipulated herein, the terms as stipulated hereinabove shall prevail over only to the extent of contradiction and remaining terms of “Hyundai Bluelink Acceptance of Terms of Use” shall remain same.

9. Termination/ Restriction of Use

  • We can terminate your Bluelink immediately if you breach Terms & Conditions herein, do not pay Subscription Fee and payment Schedule as stated above that are due, interfere with our efforts to provide Bluelink, interfere with our business, or if your Bluelink or wireless phone number is used for illegal or improper purposes. You do not have any right to have Bluelink reactivated, even if you cure any of these problems. Whether to allow you to have Bluelink again will be entirely up to us. In the event we cancel your Bluelink for a cause, we will not refund any prepaid or unused portions of your fees. We can also suspend it for network or system maintenance or improvement or if there is network congestion or if we suspect your Bluelink is being used for any purpose that would allow us to cancel it.

10. Miscellaneous

  • 10.1. The repair, if any, to make Head Unit fully functional shall be at the cost of the owner only.
     
    10.2. In theft cases, there is high probability that Bluelink will not function due to possible interruption in the circuits, using network jammers or usage of instruments by the thieves to disable Bluelink services.
     
    10.3. The registered owner shall be responsible, in case of resale of vehicle, to delink their enrollment to avoid any kind of inconvenience failing which HMID or its Dealers shall not be responsible under whatsoever circumstances.
     
    10.4. In case of any audit by any government authorities and owner mismatch found, it will be the responsibility of the registered owner to bear all consequences.
     
    10.5. Road-Side Assistance (RSA) services shall not be part of this paid subscription. The Customer may be charged for RSA services, if required, separately. The only part that included in paid subscription is RSA/Bluelink button/feature in vehicle.
     
    10.6. SOS services shall not be part of this paid subscription. The Customer may be charged for SOS services, if required, separately. The only part that included in paid subscription is SOS button/feature in vehicle.

13. Miscellaneous

  • 13.1. These Terms of Use for the Hyundai Bluelink services and any given data protection declaration (e.g. your consent) are the entire agreement of the parties with respect to the subject matter of the use of the Services and supersedes all prior agreements, written or oral, between the parties with respect to the subject matter.

    13.2. Deviating, conflicting or supplementing terms and conditions of the User shall only govern the use of the Services if explicitly accepted by us in writing.

    13.3. We will only accept other or additional terms if we have explicitly accepted them in writing.

    13.4. We may assign our rights and obligations under our contract with you either in full or in part to a third party. We will notify you of the intended assignment at least four weeks in advance. If you do not agree with the assignment, you can terminate your contract with us at any time (we will remind you of this when we inform you about the intended assignment).

    13.5. Any amendments and additions to the Terms of Use as well as notifications necessary for their execution require text form (including email, fax) to be effective. The text form requirement can only be overruled in text form.

    13.6. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

    13.7. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

    13.8. These Terms are governed by Indonesian law and you can bring legal proceedings in respect of the products in the Indonesian courts.
