Chapter 4 Obligations of Contracting Parties
Article 16 (Obligations of the company)
① The Company does not provide, disclose, or distribute the member's personal information acquired in connection with the provision of 'Hyundai ID' (tentative name) to a third party without the consent of the member. However, this is not the case if the company has lawful basis according to the provisions of the applicable laws, such as a request from a related agency for investigation purposes under the relevant laws and regulations.
② In relation to work, the Company may create and use the personal information of all or part of the member as statistical data that cannot distinguish the information of a specific member without the member's prior consent, and may transmit cookies to the member's computer for this purpose under the Cookies Policy [link to Cookies Policy].
③ The Company must promptly process complaints from members related to 'Hyundai ID' (tentative name), and if it is difficult to process quickly, the reason and processing schedule will be posted on the 'Hyundai ID' (tentative name) screen or E -Notify the member through e-mail, etc.
④ In the event that a member suffers damages due to the 'Hyundai ID' (tentative name) provided by the Company, the Company’s liabilities are limited only if such damages are caused intentionally or negligently by the Company.
⑤ The Company complies with laws related to the operation and maintenance of 'Hyundai ID' (tentative name), such as laws telecommunication business, personal data protection, computer crime, trade secret etc. PDPA.
Article 17 (Obligations of Members)
① When using 'Hyundai ID' (tentative name), members must not engage in any of the following acts.
1. Entering false information when applying for or changing use, stealing or fraudulently using another member's ID and password, using another person's name, or text message (SMS) authentication, universal authentication, or credit without the owner's permission or the act of performing card authentication, etc.
2. Copying, distributing, or commercially using information obtained using the Company's 'Hyundai ID' (tentative name) without prior consent from the Company and affiliates
3. Acts that damage or disadvantage others' reputation
4. Infringement of copyright and other rights of the Company or a third party
5. Distributing information, sentences, figures, voices, etc. that violate public order and morals to others
6. An act of registering or distributing Computer virus infection data that causes malfunction or information destruction and confusion of equipment related to 'Hyundai ID' (tentative name)
7. Information that may intentionally interfere with the operation of 'Hyundai ID' (tentative name) or the stable operation of 'Hyundai ID' (tentative name), and advertising information or spam mail against the recipient's explicit intention to reject receiving sending spam messages
8. Acts of pretending to be others and falsely specifying the relationship with others
9. Collecting, storing and disclosing personal information of other members
10. An act of distributing false information for the purpose of giving property benefits to oneself or others or causing damage to others
11. Gambling or gambling with property
12. Arranging prostitution or distributing information that mediates fornication
13. Interfering with the daily life of the other party by continuing to reach the other party with words, sounds, texts, images or videos that cause shame, disgust or fear
14. Changing the information posted on the website or on the 'Hyundai ID' (tentative name) provision screen
15. Transmission or posting of information (including computer programs) whose transmission or posting is prohibited by relevant laws and regulations
16. Disguising or impersonating an employee or operator of the Company or its affiliates, or stealing someone else's name to post or send e-mails or messages
17. An act of posting, e-mailing, or sending material containing software viruses, other computer codes, files, and programs designed to disrupt or destroy the normal operation of computer software, hardware, and telecommunications equipment.
18. Harassing other members such as stalking
19. Other illegal activities
② Members must comply with related laws, the provisions of this agreement, user guide, notices announced on the website or 'Hyundai ID' (tentative name) provision screen, matters notified by the Company and related companies, and other companies or related companies. Members must not do anything that interferes the company’s work.
③ Members cannot engage in business activities to sell products using 'Hyundai ID' (tentative name), unless officially recognized by the Company and related companies. You cannot illegally distribute commercial software. The Company is not responsible for the results and losses of business activities caused by violation of this, legal measures such as arrest by related organizations, unless there is a cause attributable to it, and the member at fault suffers damages to the Company in relation to such acts obliged to indemnify.
④ Members must update immediately when there is a change in registration information. If the registration information and updated registration information provided by the member is incorrect, or if the other member has performed the act specified in paragraph 1 of this Article, the Company prohibits the use of the member's ID in accordance with Article 21 of the 'Hyundai ID' (tentative name) terms and conditions can be limited or stopped.
Article 18 (Obligations and Responsibilities for Member ID and PASSWORD Management)
① Members are responsible for the consequences of negligent management and illegal use of member IDs and passwords, and the Company is responsible for problems arising from reasons attributable to the Company, such as Company system failures.
Members should not allow a third party to use their ID and Password, and if they are aware that their ID and Password are stolen or used by a third party, they must notify the Company and related companies immediately. If notified and guided by the Company and related companies, you must follow them.
②In order to prevent the spread of damages due to leakage of personal information, the member must perform the password change procedure after self-authentication according to the Company's password operation policy, and if the password change procedure is not performed according to the Company's password operation policy login may be restricted to protect member's personal information.
③ The member's ID cannot be changed without the Company's prior consent.
Article 19 (Notification to Members)
When notifying a member, the Company can do so through the e-mail address or SMS registered by the member.
① The Company may post on the website or the 'Hyundai ID' (tentative name) provision screen if it is difficult for the member to notify individually because the contact information has not been listed or has been changed, or when the Company announces to a number of unspecified members in accordance with these terms and conditions.
Article 20 (Change and Protection of Personal Information)
① Members must immediately amend the changes with the latest information when the information entered at the time of application for use is changed. However, items that cannot be changed, such as real names, cannot be modified.
② Damages caused by information that has not been modified in accordance with Paragraph 1 are borne by the member, and the Company is not responsible for this unless there is a cause attributable to it.
The Company does not use the member's information for purposes other than providing 'Hyundai ID' (tentative name) and individual services, or provide it to a third party, if the consent of the member is obtained. However, the following cases are exceptions.③
1. If there are lawful basis according to the provisions under the applicable laws.
2. When a member is unable to express his/her intention or cannot obtain prior consent from a member due to unknown address, etc., and it is deemed absolutely necessary to protect the life, body, or property of a member or a third party or individual cannot be identified as necessary for statistical writing, academic research, etc.
④The Company strives to protect the personal information of members, including member registration information, in accordance with the applicable personal data protection and other relevant laws and regulations. Regarding the protection of the member's personal information, the related laws and the Company's personal information processing under the Privacy Policy [link to. Privacy Policy] are followed.
⑤ In principle, the Company performs tasks such as processing and management of collected personal information (hereinafter referred to as “Work”) by itself, but if necessary, part or all of the Work may be entrusted to an organization selected by the Company. Matters concerning the entrustment of personal information are subject to the relevant laws and the Privacy Policy as set forth by the Company .
